1. Acceptance of Terms

By downloading, installing, accessing, or using Concrete Calculator & Cost Est ("the App"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

Concrete Calculator & Cost Est is developed and operated by Storq Labs BV ("Company," "we," "us," or "our"), a company registered in the Netherlands.

2. Description of Service

Concrete Calculator & Cost Est is a mobile application designed to help contractors and DIY homeowners estimate concrete volumes and bag counts. The App enables users to:

• Calculate concrete volume for slabs/patios (length x width x thickness)
• Calculate concrete volume for post holes/cylinders (diameter x depth x quantity)
• Calculate concrete volume for stairs (total rise x run x width x steps)
• Calculate concrete volume for footers/footings (length x width x depth)
• Estimate bag counts for 60lb and 80lb bags based on typical yields
• Estimate material costs based on user-entered or default prices
• Apply adjustable waste factor (0-20%)
• Switch between imperial and metric measurements
• Save and load projects locally (Pro feature)

All data is stored locally on your device only. We do not have access to your calculation data or saved projects.

3. Intended Use and Audience

This App is designed for:

• Adult DIY homeowners planning concrete projects
• Professional contractors estimating material requirements
• Individuals who need quick concrete volume estimates for planning purposes

This App is NOT a substitute for professional structural engineering, licensed contractor services, or certified building inspections. It is an estimation tool to help you plan material purchases more efficiently.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal or internal business purposes.

You may NOT:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove, alter, or obscure any proprietary notices or labels
• Use the App to develop a competing product or service
• Use the App in any way that violates applicable laws or regulations

5. No Account Required

The App does not require account creation or login. All data is stored locally on your device. We do not collect, store, or have access to your calculation data or saved projects.

6. Calculation Limitations and Disclaimer

You acknowledge and agree that:

• All calculations are estimates based on user-entered dimensions and typical yield values
• Bag yield values (60lb = 0.45 cu ft, 80lb = 0.60 cu ft) are industry averages that vary by manufacturer, product line, and mixing conditions
• Actual concrete volume requirements depend on subgrade conditions, formwork precision, and settling
• The waste factor (0-20%) is a configurable suggestion; actual waste depends on site conditions, formwork quality, mixing technique, and spillage
• Cost estimates use prices that may not reflect current local pricing at your retailer
• Results depend entirely on the accuracy of user-entered dimensions - incorrect inputs produce incorrect outputs
• You are solely responsible for verifying all calculations before purchasing materials
• We are not liable for any material shortages, excess purchases, or cost discrepancies
• This app does not account for structural requirements, rebar spacing, reinforcement needs, or building code compliance

7. User Responsibilities

You represent and warrant that:

• All dimensions and measurements you enter are accurate
• You will verify all calculation results independently before relying on them
• You will consult with qualified professionals (structural engineers, licensed contractors) for any structural or load-bearing concrete work
• You will comply with all applicable building codes, permits, and regulations in your jurisdiction
• You understand that calculations are estimates and will purchase materials accordingly

8. Prohibited Uses

You agree NOT to use the App to:

• Provide professional engineering or structural calculations without proper licensure
• Make safety-critical structural decisions without independent professional verification
• Violate any applicable laws, building codes, or regulations
• Attempt to circumvent any security or access control measures
• Use the App in any manner that could damage, disable, or impair the App

9. In-App Purchases

9.1 Free Tier

The free version includes:

• Slab/Patio calculator
• Post Hole/Cylinder calculator
• Footer/Footing calculator
• Bag count calculations (60lb and 80lb)
• Volume results in cubic yards, cubic feet, and cubic meters
• Imperial and metric unit support

9.2 Pro Version ($4.99 USD - Lifetime)

The Pro version is available as a one-time in-app purchase ($4.99 USD or local equivalent) and includes:

• Stairs calculator
• Cost estimator
• Adjustable waste factor (0-20%)
• Save and load projects

9.3 Payment Processing

All purchases are processed exclusively through the Apple App Store. We do not collect, process, or store any payment information. By making a purchase, you agree to Apple's terms and conditions.

10. Disclaimer of Warranties

WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT:

• Concrete volume calculations will be accurate for your specific project
• Bag count estimates will match actual material requirements
• Cost estimates will reflect actual prices at your local retailer
• The waste factor will accurately predict material waste for your site conditions
• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Any errors in the App will be corrected
• The App will be compatible with your device or operating system

11. Limitation of Liability

SPECIFICALLY, WE ARE NOT LIABLE FOR:

• Material shortages or excess purchases resulting from calculations
• Construction defects arising from reliance on the App's estimates
• Structural failures of any kind
• Cost overruns on any construction project
• Personal injury or property damage related to concrete work
• Data loss from device failure or app uninstallation

OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount you actually paid for the Pro version; or
• Five US Dollars ($5.00)

12. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Construction decisions made based on the App's calculations
• Material purchases based on the App's estimates
• Your violation of these Terms or any applicable law
• Any claim by a third party related to construction work where the App's calculations were used
• Any personal injury or property damage claims

13. Modifications, Termination & Service Availability

13.1 Modifications to the App

We reserve the absolute right to modify, suspend, or discontinue the App (or any features thereof) at any time, with or without notice, for any reason. This includes calculation methods, yield values, and feature availability. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

13.2 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated effective date. Your continued use of the App constitutes acceptance of modified Terms.

13.3 Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason. Upon termination, your license to use the App terminates immediately.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of telecommunications or information systems, or any other circumstances beyond our reasonable control.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Subject to the arbitration provisions in Section 16, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@storqlabs.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

16.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the App shall be finally resolved by binding arbitration administered by a mutually agreed-upon arbitration body under its rules then in effect.

16.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Waiver

The failure of Storq Labs BV to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Storq Labs BV.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements, communications, or understandings, whether oral or written, regarding the subject matter hereof.
