1. Acceptance of Terms

By downloading, installing, or using Cornhole Stats (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Cornhole Stats is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Description of Service

Cornhole Stats is a mobile scorekeeper app for the game of cornhole (bean bag toss) that:

• Tracks scores for two teams/players per game
• Implements ACO (American Cornhole Organization) cancellation scoring rules
• Saves game history locally on your device
• Allows you to share game results as images
• Provides haptic feedback during gameplay (optional)
• Works entirely offline with no internet required

3. Score Accuracy and Game Rules

You expressly acknowledge and agree that:

• Score Accuracy: We make NO warranty that scores are calculated correctly. The app performs calculations based on user input, which may contain errors.
• User Verification: You are solely responsible for verifying all scores during and after gameplay.
• Not Official Records: Game records stored in this app are for personal entertainment only and do NOT constitute official or legal records of any kind.
• No Affiliation: While we strive to implement official ACO rules correctly, this app is NOT affiliated with, endorsed by, or certified by the American Cornhole Organization or any other cornhole governing body.
• Rules Disclaimer: Rules implemented may not reflect the latest official updates. Users should verify current rules through official sources.
• Tournament Use: The app is NOT designed for official tournament use. We provide no warranty of fitness for competitive play.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent. We reserve all rights not expressly granted in these Terms.

5. User-Generated Content

Team names and player names you enter are user-provided content:

• Your Responsibility: You are solely responsible for the content of names you enter
• Local Storage: Names are stored locally on your device only
• Shared Content: When you share game results, you are responsible for how and where that content is shared
• Appropriate Content: Do not enter inappropriate, offensive, or illegal content

6. Share Feature Disclaimer

• Shared images contain game scores and team names you entered
• We are not responsible for how shared images are used by others
• Sharing is done through your device's standard share functionality
• Third-party platforms you share to have their own terms and privacy policies

7. No Reliance & User Responsibility

You acknowledge and agree that:

• Entertainment Only: The app is for personal entertainment purposes only
• No Reliance: You must not rely solely on app scores for any purpose
• User Assumes Risk: You assume all risk associated with using the app
• Disputes: We are not responsible for scoring disputes between players

8. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements, including tournament or competitive use
• Non-Infringement: No warranty that the App does not infringe third-party rights
• Error-Free Operation: No warranty that the App will operate without errors or interruptions
• Accuracy: No warranty that scores, statistics, or calculations are accurate
• Availability: No warranty of uninterrupted service or future availability
• Rules Accuracy: No warranty that implemented rules match current official ACO or other governing body rules

9. Limitation of Liability

WE DISCLAIM ALL LIABILITY. The developer is NOT responsible for:

• Scoring Errors: Any errors in score calculations or display
• Scoring Disputes: Disagreements between players based on app scores
• Tournament Issues: Any issues arising from tournament or competitive use
• Financial Losses: Any losses from betting, tournaments, or competitions based on app scores
• Data Loss: Lost game history or settings due to app deletion, OS updates, or device issues
• Device Issues: Battery drain, device overheating, or other device issues
• Shared Content: Any issues arising from content you choose to share

Maximum Liability: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP ($0.00 USD FOR FREE APPS).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Intellectual Property

The App, including its code, design, graphics, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV.

Note: "Cornhole" is a generic game name and is not trademarked by us. We make no claim to the term itself. "ACO" and "American Cornhole Organization" are trademarks of their respective owners.

11. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Claim the App provides official scoring or is affiliated with ACO or other governing bodies
• Use the App as the sole official scoring system for sanctioned tournaments without independent verification
• Enter offensive, inappropriate, or illegal team/player names
• Use the App for commercial purposes without written consent

12. Data Loss Disclaimer

All data is stored locally on your device. We provide no guarantee of data persistence:

• Local storage can be cleared by the OS or user actions
• Deleting the app will delete all stored data
• OS updates may affect local storage
• You are responsible for keeping any important records separately

13. Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes with other players based on App scores
• Any claims related to tournament or competitive use
• Content you enter or share through the App
• Any claims that you relied on the App for official scoring

14. Age Restrictions

Cornhole Stats is a general audience app suitable for users of all ages. Since we do not collect any personal information, there are no special age restrictions. Parents and guardians are responsible for monitoring their minor's use of the App.

15. App Availability & Discontinuation

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from app stores
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

CONTINUED USE CONSTITUTES ACCEPTANCE of any modifications to these Terms.

16. Future Features

We may introduce additional features in the future, including but not limited to:

• Premium Features: Subscription-based or one-time purchase pro features
• Advertisements: Interstitial ads, rewarded ads, or other advertising formats
• Analytics: Usage analytics to improve the app

Any in-app purchases or subscriptions will be governed by the respective policies of Apple App Store and Google Play Store. Refunds for any purchases must be requested through Apple or Google, not through us.

17. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at hello@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations, to the extent permitted by law.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

Users in other jurisdictions use this app at their own risk. We will comply with local laws where legally required but limit liability to the maximum extent permitted by law.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government actions, power failures, internet outages, or any other force majeure event.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements. This App is a convenience tool for personal entertainment, not a professional scoring system.
