Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Figurines (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Figurines is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Description of Service

Figurines is an entertainment app that:

• Allows users to take or select selfies
• Provides action templates (activities for figurines)
• Sends photos to our backend API for AI processing via Google Gemini 2.0 Flash
• Generates 4 AI-created miniature isometric figurine variants
• Stores generated figurines locally on your device
• Allows sharing figurines to messaging apps and social media

Internet Required: An internet connection is required to generate figurines. The app relies on external servers and AI services.

3. AI-Generated Content Disclaimer

You expressly acknowledge and agree that:

• NO GUARANTEE OF RESULTS: Generated figurines may not accurately represent the submitted photo
• RESULTS VARY: The AI may produce unexpected, unflattering, or inaccurate results
• ENTERTAINMENT ONLY: Generated content should not be relied upon for any commercial, legal, or professional purpose
• NO WARRANTY: We make no warranty regarding the quality, appropriateness, or consistency of AI-generated content

4. User Content & Photo Submissions

When you submit photos to the App:

• Your Responsibility: You are solely responsible for the content of photos you submit
• Rights Required: You must have the legal right to use and submit any photos
• Consent Required: Do NOT submit photos of others without their explicit consent
• Appropriate Content: Do NOT submit inappropriate, illegal, or offensive photos
• No Minors: Do NOT submit photos of children under 13
• AI Processing: Photos are sent to Google Gemini AI for processing. Google's terms apply to their processing

5. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use.

Generated Content: You may use generated figurines for personal, non-commercial use. Commercial use of generated content requires our prior written permission.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

6. SERVICE AVAILABILITY

You acknowledge and agree that:

• No Uptime Guarantee: There is NO service level agreement. No minimum uptime is promised or implied
• Outages: Service may experience outages, interruptions, errors, or downtime at any time for any reason or no reason
• Backend Dependency: The app relies on third-party AI services and backend infrastructure that may become unavailable, rate-limited, or discontinued at any time
• Discontinuation Rights: We reserve the absolute right to modify, suspend, or permanently discontinue the service at any time, for any reason, with or without notice, and without liability
• No Refunds for Outages: You are NOT entitled to refunds, credits, or compensation for service interruptions, outages, or discontinuation
• No Liability for Downtime: We shall NOT be liable for any damages, losses, or inconvenience resulting from service unavailability
• Third-Party Dependencies: Service depends on third-party providers (Google Gemini AI, cloud infrastructure) over which we have no control; we are not liable for third-party outages or changes
• Maintenance: Service may be unavailable during maintenance periods, which may occur without prior notice
• Feature Changes: Features may be added, modified, or removed at any time without notice
• Best Effort Only: Service is provided on a "best effort" basis only

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.

7. In-App Purchases

Figurines offers in-app purchases for action packs:

• Action Packs: One-time purchases ($0.99-$2.99) for additional activity templates
• Pro Subscription: May be offered ($4.99/month) with auto-renewal
• Payment Processing: All payments handled by Apple App Store or Google Play Store
• Refunds: Refund requests must be made through Apple or Google, not through us
• No Refunds for Service Issues: Purchases are non-refundable for service outages or discontinuation (see Section 6)

Subscription terms, auto-renewal, and cancellation are governed by Apple App Store and Google Play Store policies.

8. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements
• Non-Infringement: No warranty that the App does not infringe third-party rights
• Error-Free Operation: No warranty that the App will operate without errors or interruptions
• Accuracy or Likeness: No warranty that generated figurines will accurately represent you
• AI Quality: No warranty regarding the quality, appropriateness, or consistency of AI-generated content
• Availability: No warranty of uninterrupted service or future availability

9. Limitation of Liability

WE DISCLAIM ALL LIABILITY. The developer is NOT responsible for:

• AI-Generated Content: Inaccurate, unexpected, or unflattering results
• Service Unavailability: Any outages, interruptions, or discontinuation of service
• Data Loss: Lost figurines or other local data
• Third-Party Actions: Actions of Google, other third parties, or other users
• User Sharing: How you or others use or share generated content
• Device Issues: Battery drain, storage usage, or other device issues
• Purchase Issues: In-app purchase problems (contact Apple/Google)

Maximum Liability: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE PRECEDING 12 MONTHS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Prohibited Uses

You agree not to:

• Submit photos of others without their consent
• Submit inappropriate, illegal, or offensive photos
• Submit photos of children under 13
• Use generated content for harassment, defamation, or illegal purposes
• Create deepfakes or misleading content
• Use generated content commercially without permission
• Reverse engineer, decompile, or disassemble the App
• Attempt to overload or abuse our API services
• Redistribute, sell, or sublicense the App
• Misrepresent the nature or capabilities of the App to others

11. Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Photos or content you submit to the App
• How you use or share generated content
• Any claims that generated content infringes third-party rights

12. Intellectual Property

The App, including its code, design, graphics, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV. You retain ownership of photos you submit, but grant us a limited license to process them for providing the service. The figurine style and concept are proprietary to Storq Labs BV.

13. Age Restrictions

Figurines is intended for users aged 13 and older. By using this app, you confirm that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

14. Modifications to Service and Terms

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from app stores
• Change these Terms at any time
• Change pricing for in-app purchases
• Terminate your license to use the App if you violate these Terms

CONTINUED USE CONSTITUTES ACCEPTANCE of any modifications to these Terms.

15. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at support@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations, to the extent permitted by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements.
