Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flag Football Scoreboard (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Flag Football Scoreboard is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Description of Service

Flag Football Scoreboard is a mobile app that:

• Tracks game scores (touchdowns, extra points, safeties)
• Manages game clock and periods
• Tracks ball position on field
• Records possession, downs, and distance
• Tracks team timeouts
• Saves game history locally on your device
• Allows sharing of game results as images
• Supports multiple rule presets (NFL Flag, i9 Sports, Adult Rec, Custom)

3. Age Requirements

Flag Football Scoreboard is designed for use by adult coaches and coordinators:

• Users must be 13 years of age or older to use this App
• If you are under 18, you must have parental or guardian consent to use this App
• The App is intended for adult coaches managing youth or adult flag football games
• The App is not targeted at or designed for use by children directly

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

5. Pricing and Future Changes

Flag Football Scoreboard is currently offered as a free app with no in-app purchases, subscriptions, or advertisements.

We reserve the right, at our sole discretion, to:

• Introduce paid features, subscriptions, or in-app purchases in future versions
• Change the pricing model at any time without prior notice
• Add advertisements to future versions of the App
• Modify, limit, or remove features at any time

Any such changes will be reflected in updated Terms or in-app notifications. Continued use of the App after changes constitutes acceptance.

6. Score Accuracy, Clock, and Game Data

Please understand the following:

• Score Accuracy: The App is a tool to assist with scorekeeping. We are not responsible for scoring errors, disputes, or officiating decisions. Users are responsible for verifying all scores.
• Clock Accuracy: The game clock is for reference only. We are not responsible for timing discrepancies. The clock is not certified timing equipment.
• Game Data: Ball position, downs, distance, and other game data are user-entered and user-managed. We are not responsible for data entry errors.
• No Affiliation: We are NOT affiliated with the NFL, NFL Flag, i9 Sports, USA Football, or any other league, organization, or governing body. Preset names and rules are for convenience only and represent community-standard configurations, not official rules.
• Game Outcomes: We have no responsibility for game outcomes, disputes, or decisions made based on App data.
• Rule Verification: Rules and configurations may not reflect the latest official updates from leagues. Users should verify current rules independently through official sources.

7. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use.
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements or is suitable for official, competitive, or tournament use.
• Non-Infringement: No warranty that the App does not infringe third-party rights.
• Error-Free Operation: No warranty that the App will operate without errors, bugs, or interruptions.
• Accuracy: No warranty that scores, clock times, statistics, or calculations are accurate, complete, or reliable.
• Availability: No warranty of uninterrupted service or future availability.
• Compatibility: No guarantee of compatibility with all iOS or Android versions, devices, or future OS updates.

8. Limitation of Liability

This includes, without limitation, damages for:

• Data Loss: Lost game history or settings due to app deletion, OS updates, device failure, or any other cause
• Scoring Disputes: Disagreements, arguments, or conflicts arising from scores or data displayed in the App
• Game Outcomes: Any losses, disputes, or consequences related to game results
• Timing Errors: Any issues arising from clock inaccuracies or timing discrepancies
• Device Issues: Battery drain, screen damage, device malfunction, or any hardware issues
• Lost Profits: Any business, personal, or financial losses
• Emotional Distress: Any stress, frustration, or emotional harm from app use or disputes

Maximum Liability: Our total liability for any claims arising from the App shall not exceed the amount you paid for the App (which is currently $0.00 USD for the free version).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9. Data Loss Disclaimer

All data is stored locally on your device. We provide no guarantee of data persistence:

• Local storage can be cleared by the operating system, app updates, or user actions
• Deleting the app will permanently delete all stored data
• OS updates may affect local storage
• Device damage, loss, or replacement will result in data loss
• We cannot recover lost data because it is stored only on your device
• You are responsible for keeping any important records separately

10. User-Entered Content

You may enter custom information into the App, such as team names and colors. You are solely responsible for:

• The content you enter into the App
• Ensuring entered content does not infringe on third-party rights
• Ensuring entered content is not offensive, defamatory, or illegal
• Any consequences of sharing content via the share feature

11. Intellectual Property

The App, including its code, design, graphics, icons, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV.

Note: "Flag Football" is a generic sport name. We make no claim to the term itself. NFL, NFL Flag, i9 Sports, and other organization names are trademarks of their respective owners. We are not affiliated with these organizations.

12. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without written permission
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Use the App in violation of Apple or Google's terms of service
• Claim affiliation with the NFL, NFL Flag, i9 Sports, or any other official organization
• Use the App as official scoring equipment without appropriate verification and backup systems
• Use automated systems to access or interact with the App
• Attempt to interfere with the App's operation or security

13. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes with other players, coaches, parents, or officials based on App data
• Any claims related to competitive, tournament, or league use
• Content you enter into or share from the App

14. App Availability & Discontinuation

We reserve the absolute right to, at our sole discretion:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from app stores
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

We provide no guarantee of future updates, bug fixes, or OS compatibility. Continued use of the App after any modifications to these Terms constitutes acceptance of the modified Terms.

15. Refund Policy

The App is currently free. If we introduce paid features in the future:

• All purchases will be processed entirely by Apple or Google
• All refund requests must be directed to the respective app store
• We do not process refunds directly
• Apple Refund Requests
• Google Play Refund Requests

16. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at hello@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: To the maximum extent permitted by applicable law, any disputes shall be resolved on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative actions.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of third-party services, or changes to app store policies.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements, communications, or understandings.
