Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Mortgage Calculator Clear ("the App"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

Mortgage Calculator Clear is developed and operated by Storq Labs BV ("Company," "we," "us," or "our"), a company registered in the Netherlands.

2. Description of Service

Mortgage Calculator Clear is an educational mobile application designed to help users understand how mortgages work through interactive calculations and plain-English explanations. The App enables users to:

• Explore how home price, down payment, interest rate, and loan term affect monthly payments and total interest (Mortgage Sandbox)
• View personalized amortization curves and principal vs interest breakdown (Dashboard)
• Calculate extra payment savings in real time (Power Pay Calculator)
• Compare current vs refinanced loan with break-even analysis (Refinance Comparison)
• Project future home value, equity growth, and net profit/loss (Home Investment Return)
• Compare total costs of renting vs buying (Buy vs Rent)
• Learn mortgage concepts through educational cards and glossary (Learning Mode)
• Export scenarios as branded images via the share sheet

All calculations are performed entirely on-device using deterministic math formulas. No AI, machine learning, or cloud processing is involved. All data is stored locally on your device only.

3. Intended Use and Audience

This App is designed for:

• Adults (ages 25-55) seeking to understand mortgage concepts
• Prospective homebuyers exploring hypothetical mortgage scenarios
• Current homeowners reviewing their mortgage progress or considering refinancing

This App is NOT directed at children under 13. It is NOT a financial advisory service, lending platform, or mortgage broker. It provides educational estimates only.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial educational purposes.

You may NOT:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove, alter, or obscure any proprietary notices or labels
• Use the App to develop a competing product or service
• Use the App's output as professional financial advice for third parties
• Scrape, extract, or commercially redistribute the educational content, learning cards, or glossary definitions

5. No Account Required

The App does not require account creation or login. All data is stored locally on your device. We do not collect, store, or have access to your mortgage parameters or calculation data. We reserve the right to introduce optional account features in the future.

6. Calculation Limitations and Disclaimer

You acknowledge and agree that:

• All calculations are estimates based on standard amortization formulas (fixed-rate, fully amortizing loans)
• Monthly payment estimates do not include property taxes, homeowner's insurance, PMI, HOA fees, closing costs, or escrow unless explicitly stated
• Interest rates used are user-entered assumptions and may not reflect actual available rates
• Refinance savings calculations are hypothetical and depend on actual terms offered by lenders
• Home value projections use assumed appreciation rates that are not guaranteed
• Buy vs rent comparisons use simplifying assumptions and do not capture all costs
• Extra payment savings depend on your lender's policies regarding prepayment
• You are solely responsible for verifying all calculations with your lender before making financial decisions

7. User Responsibilities

You represent and warrant that:

• You understand that all calculations are educational estimates only
• You will consult a qualified financial advisor, mortgage broker, or attorney before making mortgage decisions
• You will verify all calculations with your actual lender before committing to any mortgage
• You will not rely solely on this app for financial planning or decision-making
• You understand that shared scenario images contain user-entered financial data and you are responsible for what you share

8. Prohibited Uses

You agree NOT to use the App to:

• Provide professional financial, tax, or legal advice to third parties
• Market or promote lending products or mortgage services
• Make financial decisions without independent professional verification
• Commercially redistribute calculation results, educational content, or glossary definitions
• Attempt to circumvent any security or access control measures
• Violate any applicable laws or regulations

9. Intellectual Property

All content in the App, including but not limited to the user interface, educational learning cards, glossary definitions, design elements, text, graphics, and software, is owned by Storq Labs BV and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content in the App without our prior written consent.

10. In-App Purchases

10.1 Free Tier

The free version includes full mortgage calculator functionality with banner and interstitial advertisements.

10.2 Premium ($4.99 USD - One-Time Purchase)

The Premium version is available as a one-time in-app purchase ($4.99 USD or local equivalent) and includes:

• Ad-free experience (all ads removed)
• Unlimited scenario sharing

No subscriptions or recurring charges apply.

10.3 Payment Processing

All purchases are processed exclusively through the Apple App Store. We do not collect, process, or store any payment information. By making a purchase, you agree to Apple's terms and conditions.

11. User-Generated Content

The App allows you to generate and share scenario cards that contain your user-entered financial data. By sharing these cards:

• You are responsible for the accuracy and appropriateness of shared content
• Shared scenario cards include the App's branding and disclaimer text
• We disclaim any liability for financial decisions made by third parties based on your shared scenarios

12. Disclaimer of Warranties

WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT:

• Mortgage payment calculations will match actual lender terms
• Amortization schedules will reflect actual payment allocations
• Refinance savings estimates will match actual refinancing outcomes
• Home value projections will reflect actual future property values
• Buy vs rent comparisons will accurately predict total costs
• Extra payment calculations will match your lender's prepayment terms
• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Any errors in the App will be corrected

13. Limitation of Liability

SPECIFICALLY, WE ARE NOT LIABLE FOR:

• Financial decisions made based on the App's calculations
• Mortgage commitments or home purchases influenced by estimates
• Refinancing decisions based on the App's comparison tool
• Investment losses from reliance on projected home values
• Any difference between estimated and actual mortgage costs
• Data loss from device failure or app uninstallation

OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount you actually paid for the Premium version; or
• Five US Dollars ($5.00)

14. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Financial decisions made based on the App's calculations
• Mortgage commitments or property purchases influenced by the App's estimates
• Your violation of these Terms or any applicable law
• Any claim by a third party related to financial decisions where the App's calculations were used
• Shared scenario cards containing inaccurate or misleading information

15. Modifications, Termination & Service Availability

15.1 Modifications to the App

We reserve the absolute right to modify, suspend, or discontinue the App (or any features thereof) at any time, with or without notice, for any reason. This includes calculation methods, formulas, educational content, and feature availability. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

15.2 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated effective date. Your continued use of the App constitutes acceptance of modified Terms.

15.3 Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason. Upon termination, your license to use the App terminates immediately.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of telecommunications or information systems, or any other circumstances beyond our reasonable control.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Subject to the arbitration provisions in Section 18, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

18. Dispute Resolution and Arbitration

18.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@storqlabs.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

18.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the App shall be finally resolved by binding arbitration administered by a mutually agreed-upon arbitration body under its rules then in effect.

18.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. Waiver

The failure of Storq Labs BV to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Storq Labs BV.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements, communications, or understandings, whether oral or written, regarding the subject matter hereof.
