Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Padel Score Tracker (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Padel Score Tracker is developed and operated by Storq Labs BV ("Storq Labs," "we," "us," or "our"), an independent developer based in the Netherlands.

2. Description of Service

Padel Score Tracker is a mobile application that:

• Tracks padel match scores (points, games, and sets)
• Handles deuce, advantage, and tiebreak scenarios automatically
• Maintains a local history of completed matches
• Allows users to share match results as images
• Works completely offline with no internet connection required

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

4. Pricing and Future In-App Purchases

Padel Score Tracker is currently offered as a free application with no advertisements, subscriptions, or in-app purchases.

We reserve the right to introduce paid features, in-app purchases, or a Pro upgrade in future versions. Any such changes will be clearly communicated through app updates. If in-app purchases are added:

• All purchases will be processed by Apple (App Store) or Google (Play Store)
• We will not process payments directly or store payment information
• Purchases will be subject to the respective platform's terms and conditions
• Refunds must be requested through the respective app store

5. Score Accuracy and Game Rules

Please understand the following:

• Score Accuracy: We are not responsible for scoring disputes or errors. The app may contain bugs that affect score tracking. Users are responsible for verifying scores.
• Game Rules: Padel scoring rules implemented in the app are based on publicly available information and may not reflect the latest official updates from governing bodies.
• No Affiliation: We are NOT affiliated with the International Padel Federation (FIP), World Padel Tour (WPT), or any other padel governing body or organization.
• Tournament Use: The app is NOT designed for official tournament use. We provide no warranty of fitness for competitive play. Do NOT use this app for official or sanctioned tournaments without organizer approval.
• Rule Verification: Users should verify current rules independently through official sources.
• No Gambling: This app must NOT be used for gambling or betting purposes.

6. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use.
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements or be suitable for official matches.
• Non-Infringement: No warranty that the App does not infringe third-party rights.
• Error-Free Operation: No warranty that the App will operate without errors or interruptions.
• Accuracy: No warranty that scores, statistics, or calculations are accurate.
• Availability: No warranty of uninterrupted service or future availability.
• Compatibility: No guarantee of compatibility with all iOS or Android versions.
• Data Preservation: No warranty that your match history or settings will be preserved.

7. Limitation of Liability

This includes, without limitation, damages for:

• Data Loss: Lost match history or settings due to app deletion, OS updates, or device issues
• Financial Losses: Any losses from betting, tournaments, or competitions based on app scores
• Scoring Disputes: Disagreements arising from scores displayed in the app
• Device Issues: Battery drain, device overheating, or any other device-related issues
• Incorrect Scores: Decisions made based on potentially inaccurate score tracking
• Lost Profits: Any business or personal financial losses
• Missed Opportunities: Any opportunities lost due to app malfunction or inaccurate scoring

Maximum Liability: Since the App is currently free, our total liability for any claims arising from the App shall not exceed $0 USD. If paid features are added in the future, our maximum liability shall not exceed the amount you paid for those features.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Data Loss Disclaimer

All data is stored locally on your device. We provide no guarantee of data persistence:

• Local storage can be cleared by iOS/Android or user actions
• Deleting the app will delete all stored data
• OS updates may affect local storage
• Device resets or migrations may result in data loss
• You are responsible for keeping any important records separately
• We cannot recover lost data under any circumstances

9. Intellectual Property

The App, including its code, design, graphics, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV.

Note: "Padel" is a generic sport name and is not trademarked by us. We make no claim to the term itself.

10. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to extract or reverse engineer the scoring logic
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Use the App for gambling or betting purposes
• Use the App in official/sanctioned tournaments without organizer approval
• Use the App for commercial purposes without a license
• Use the App in violation of Apple's or Google's terms of service
• Claim affiliation with official padel organizations
• Use the App as an official scoring system without appropriate verification

11. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes with other players based on App scores
• Any claims related to tournament or competitive use
• Any decisions made based on scores displayed in the App

12. App Availability, Discontinuation & Refunds

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from the App Store or Play Store
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

We provide no guarantee of future updates or iOS/Android version compatibility. Continued use of the App after any modifications to these Terms constitutes acceptance of the modified Terms.

12.1 Refund Policy

The App is currently free. If paid features are introduced in the future:

• All purchases will be final unless otherwise required by applicable law
• No refunds will be issued if the App is discontinued
• No refunds will be issued if features are modified or removed
• Refund requests must be directed to Apple or Google through their respective processes

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, power failures, internet outages, or other events outside our control.

14. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at support@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations to the maximum extent permitted by law.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements.
