Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Pet Mood Translator (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Pet Mood Translator is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Entertainment Purpose & No Real Pet Mood Detection

You expressly acknowledge and agree that:

• ENTERTAINMENT ONLY: Pet Mood Translator is PURELY for entertainment/amusement purposes
• NO REAL MOOD DETECTION: The app does NOT actually detect pet emotions, moods, or feelings
• AI-GENERATED FICTION: All "mood readings" are AI-generated fictional content for entertainment
• NOT SCIENTIFIC: Results have no scientific basis whatsoever
• NOT VETERINARY ADVICE: This is NOT a substitute for professional veterinary care or animal behavioral consultation
• NOT HEALTH DIAGNOSIS: Do NOT use results to diagnose or treat any pet health condition
• NO RELIANCE: Results should NEVER be relied upon for any purpose whatsoever
• RESULTS VARY: AI-generated content may be inaccurate, inappropriate, or nonsensical

3. Description of Service

Pet Mood Translator is an entertainment app that:

• Allows users to take or select photos of their pets
• Sends photos to our backend API for AI processing via Google Gemini
• Generates fictional "mood readings" including mood type, description, and humorous "thoughts" the pet might be thinking
• Creates shareable mood cards designed for social media
• Stores mood history locally on your device

Internet Required: An internet connection is required to process photos and generate mood readings.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent. We reserve all rights not expressly granted in these Terms.

5. User Content & Photo Submissions

When you submit photos to the App for mood analysis:

• Your Responsibility: You are solely responsible for the content of photos you submit
• Pets Only: The App is designed for photos of pets (primarily dogs and cats). Do NOT submit photos of humans
• Appropriate Content: Do NOT submit inappropriate, illegal, or harmful content
• No Permanent Storage: Photos are processed temporarily and are NOT permanently stored on our servers
• AI Processing: Photos are sent to Google Gemini AI for processing. Google's terms apply to their processing

6. No Reliance & User Responsibility

You acknowledge and agree that:

• NO RELIANCE: You must not rely on results for any purpose
• NO ACCURACY: We make NO claims about accuracy (results are AI-generated fiction)
• USER RESPONSIBILITY: You are solely responsible for how you interpret, use, or share results
• CONSULT PROFESSIONALS: Always consult a qualified veterinarian for any concerns about your pet's health, mood, or behavior
• USER ASSUMES ALL RISK: You assume all risk associated with using the app

7. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements
• Non-Infringement: No warranty that the App does not infringe third-party rights
• Error-Free Operation: No warranty that the App will operate without errors or interruptions
• Accuracy: No warranty that results are accurate or meaningful (they are AI-generated fiction)
• Pet Mood Detection: No warranty of any pet emotion or mood detection capability (because none exists)
• AI Quality: No warranty regarding the quality, appropriateness, or consistency of AI-generated content
• Availability: No warranty of uninterrupted service or future availability

8. Limitation of Liability

WE DISCLAIM ALL LIABILITY. The developer is NOT responsible for:

• Pet Health Decisions: Any decisions about your pet's health or care based on app results
• Veterinary Delays: Delays in seeking proper veterinary care due to reliance on app results
• Emotional Distress: Any emotional distress from results or interpretations
• Misunderstandings: Any misunderstandings about the app's capabilities or the meaning of results
• Data Loss: Lost mood history or other local data
• AI Content: Inappropriate, inaccurate, or offensive AI-generated content
• Third-Party Actions: Actions of Google, other third parties, or other users
• Device Issues: Battery drain, device overheating, or other device issues

Maximum Liability: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP ($0.00 USD FOR FREE APPS).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9. Intellectual Property

The App, including its code, design, graphics, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV. You retain ownership of photos you submit, but grant us a limited license to process them for providing the service.

10. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Submit photos of humans or inappropriate content
• Claim the App provides real pet emotion detection
• Claim results are real, factual, or scientifically valid
• Use results to make decisions about pet health or care
• Share results as if they represent actual pet emotions
• Use the App for commercial purposes without written consent
• Misrepresent the nature or capabilities of the App to others
• Attempt to overload or abuse our API services

11. Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Photos or content you submit to the App
• Any decisions you make based on app results
• Delays in seeking proper veterinary care
• Any claims that you relied on the App for real pet health information
• Sharing of results with others

12. Age Restrictions

Pet Mood Translator is intended for users aged 13 and older. By using this app, you confirm that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the App. Parents and guardians are responsible for monitoring their minor's use of the App.

13. App Availability & Discontinuation

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from app stores
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

CONTINUED USE CONSTITUTES ACCEPTANCE of any modifications to these Terms.

14. Future Features

We may introduce additional features in the future, including but not limited to:

• Advertisements: Interstitial ads, rewarded ads, or other advertising formats
• Premium Features: Subscription-based or one-time purchase premium features
• Additional AI Features: New mood types, analysis options, or pet categories

Any in-app purchases or subscriptions will be governed by the respective policies of Apple App Store and Google Play Store. Refunds for any purchases must be requested through Apple or Google, not through us.

15. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at hello@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations, to the extent permitted by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

Users in other jurisdictions use this app at their own risk. We will comply with local laws where legally required but limit liability to the maximum extent permitted by law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements. No professional veterinary or pet care advice is being provided through this App. The App is a game/novelty entertainment application, not a tool, utility, or professional service.
