Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Pickleball Scoreboard (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Pickleball Scoreboard is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Description of Service

Pickleball Scoreboard is an iOS app that:

• Tracks pickleball match scores for singles and doubles games
• Supports multiple scoring systems (play to 11, 15, or 21 points)
• Provides Side-Out and Rally scoring options
• Stores match history locally on your device
• Keeps screen awake during active use
• Provides haptic feedback for score updates

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

4. In-App Purchases

Pickleball Scoreboard offers a Pro upgrade as a one-time, non-consumable purchase for $2.99 USD (or equivalent in your currency).

4.1 Pro Features Include:

• Unlimited match history storage
• Custom team/player names
• Match statistics dashboard
• Removal of upgrade prompts
• Access to future Pro features (no guarantee of specific features)

4.2 Payment Processing:

• All purchases are processed entirely by Apple
• We do not process payments directly
• We do not receive or store any payment information
• Purchases are subject to Apple's terms and conditions
• Restore Purchases is available for device transfers or reinstallation

4.3 Refunds:

All refunds are handled by Apple per their policies. We cannot process refunds directly. To request a refund, please visit reportaproblem.apple.com or Apple's refund support page.

5. Score Accuracy and Game Rules

Please understand the following:

• Score Accuracy: We are not responsible for scoring disputes or errors. Users are responsible for verifying scores.
• Game Rules: Rules implemented in the app are based on publicly available information and may not reflect the latest official updates from governing bodies.
• No Affiliation: We are NOT affiliated with USA Pickleball (USAP), the International Federation of Pickleball (IFP), or any other governing body.
• Tournament Use: The app is NOT designed for official tournament use. We provide no warranty of fitness for competitive play.
• Rule Verification: Users should verify current rules independently through official sources.

6. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use.
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements.
• Non-Infringement: No warranty that the App does not infringe third-party rights.
• Error-Free Operation: No warranty that the App will operate without errors or interruptions.
• Accuracy: No warranty that scores, statistics, or calculations are accurate.
• Availability: No warranty of uninterrupted service or future availability.
• Compatibility: No guarantee of compatibility with all iOS versions.

7. Limitation of Liability

This includes, without limitation, damages for:

• Data Loss: Lost match history or settings due to app deletion, iOS updates, or device issues
• Financial Losses: Any losses from betting, tournaments, or competitions based on app scores
• Scoring Disputes: Disagreements arising from scores displayed in the app
• Device Issues: Battery drain, screen burn-in from extended use, or device overheating
• Lost Profits: Any business or personal financial losses

Maximum Liability: Our total liability for any claims arising from the App shall not exceed the amount you paid for the Pro upgrade ($2.99 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Device and Screen Usage

The App includes a feature to keep your screen awake during active use. Please note:

• This feature is used at your own risk
• Extended screen-on time may affect battery life
• We are not responsible for any screen burn-in on OLED displays
• We are not responsible for device overheating during extended use

9. Data Loss Disclaimer

All data is stored locally on your device. We provide no guarantee of data persistence:

• Local storage can be cleared by iOS or user actions
• Deleting the app will delete all stored data
• iOS updates may affect local storage
• You are responsible for keeping any important records separately

10. Intellectual Property

The App, including its code, design, graphics, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV.

Note: "Pickleball" is a generic sport name and is not trademarked by us. We make no claim to the term itself.

11. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to circumvent Pro features without purchasing
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Use the App in violation of Apple's terms of service
• Claim affiliation with official pickleball organizations
• Use the App as an official scoring system without appropriate verification

12. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes with other players based on App scores
• Any claims related to tournament or competitive use

13. App Availability, Discontinuation & Refunds

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from the App Store
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

We provide no guarantee of future updates or iOS version compatibility. Continued use of the App after any modifications to these Terms constitutes acceptance of the modified Terms.

13.1 No Refunds Policy

GENERALLY, NO REFUNDS WILL BE PROVIDED. BY PURCHASING THE PRO UPGRADE OR USING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT:

• All purchases are final unless otherwise required by applicable law
• No refunds will be issued if the App is discontinued
• No refunds will be issued if features are modified or removed
• The service may end at any time without compensation
• You waive any claims related to service discontinuation to the maximum extent permitted by law

Refund requests must be directed to Apple through reportaproblem.apple.com. We do not process refunds directly.

14. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at hello@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements.
