Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Dark Reader Mode for Safari (the "App" or "Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Dark Reader Mode for Safari is developed and operated by Storq Labs ("we," "us," or "our").

2. Description of Service

Dark Reader Mode for Safari is a Safari Web Extension that:

• Applies dark mode to websites by reading and manipulating CSS stylesheets
• Injects override CSS stylesheets with dark mode color transformations
• Monitors DOM mutations to handle dynamically loaded content
• Provides per-site preferences for dark mode toggling and visual adjustments
• Includes a companion iOS app for managing settings and preferences
• Stores all settings locally on your device
• Makes zero network requests (except Apple StoreKit for purchases)

The App is a visual enhancement tool. It is not a security tool, accessibility tool, or medical device.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

4. Third-Party Content & Websites

The Extension modifies the visual appearance of third-party websites. Please understand:

• No Affiliation: We have no affiliation with the websites whose appearance the Extension modifies. Dark mode transformations are applied by the Extension, not by the websites themselves.
• Content Ownership: All website content belongs to the original publishers and content creators. We do not claim ownership of any third-party content.
• No Control: We have no control over the content, accuracy, or availability of third-party websites.
• No Endorsement: Applying dark mode to a website does not imply our endorsement of that website or its content.
• User Responsibility: You are responsible for complying with the terms of service of the websites you visit.

5. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Dark Mode Rendering: We do not guarantee that dark mode will render perfectly on all websites. Some websites use complex CSS, inline styles, dynamic content, or non-standard markup that may result in imperfect dark mode rendering.
• Website Functionality: CSS modifications may interfere with website functionality. We are not responsible for any website features that break or behave differently after dark mode is applied.
• Compatibility: We do not guarantee compatibility with all websites, all Safari versions, or all iOS versions.
• Performance: We are not responsible for any battery impact, performance impact, or data usage that may result from using the Extension.
• Availability: We do not guarantee uninterrupted or error-free operation.

6. Limitation of Liability

This includes, without limitation, damages for:

• Loss of data, profits, or business opportunities
• Dark mode rendering issues or visual artifacts on websites
• Website functionality disrupted by CSS modifications
• Inability to access or use certain websites
• Any actions taken based on the modified appearance of websites
• Battery drain, device performance, or storage usage
• Interaction with third-party websites or their terms of service

To the maximum extent permitted by law, our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you actually paid for the App in the twelve (12) months preceding the claim.

7. Intellectual Property

The App, including its code, design, graphics, dark mode rendering engine, and documentation, is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved by Storq Labs.

8. Prohibited Uses

You agree not to:

• Attempt to reverse engineer, decompile, disassemble, or derive source code from the App
• Use the App to circumvent website paywalls, access restrictions, or authentication mechanisms
• Use the App for automated scraping, data collection, or harvesting of website content
• Redistribute, sell, rent, or sublicense the App without our permission
• Use the App to infringe on the intellectual property rights of others
• Use the App for any unlawful or unauthorized purpose
• Modify, adapt, or create derivative works of the App without our prior written consent
• Remove, alter, or obscure any proprietary notices in the App

9. Custom CSS Injection (Pro Feature)

The Pro version of the App includes the ability to inject custom CSS per website. By using this feature:

• You are solely responsible for any custom CSS you write and inject
• We are not liable for any consequences of custom CSS injection, including website breakage, visual issues, or security implications
• Custom CSS is stored locally on your device and is not reviewed, moderated, or validated by us
• You agree not to use custom CSS injection for malicious purposes

10. Subscriptions & In-App Purchases

The App offers the following purchase options:

• Monthly Subscription: Auto-renewable at $0.99/month
• Lifetime Purchase: One-time payment of $4.99

10.1 Apple-Required Subscription Terms

• Payment will be charged to your iTunes Account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed and auto-renewal turned off by going to your Account Settings after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription

10.2 Lifetime Purchase

"Lifetime" means the lifetime of the App, not the lifetime of the purchaser. If the App is discontinued, the lifetime purchase grants access to Pro features for as long as the App remains functional on your device. No refund is provided upon discontinuation.

10.3 Price Changes

We reserve the right to change subscription and purchase prices at any time. Price changes for active subscriptions will take effect at the start of the next billing period following notice. Existing lifetime purchases will not be affected by price changes.

11. Refunds

All purchases of Dark Reader Mode for Safari are processed through Apple's App Store. We do not process payments directly and do not have access to your payment information.

Refund requests must be directed to Apple. Please visit reportaproblem.apple.com to request a refund. Refunds are subject to Apple's refund policies.

12. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including the terms of service of any website; (d) any custom CSS you inject using the Pro feature; or (e) any dispute between you and any third party relating to the App.

13. Modifications, Termination & Service Availability

We reserve the absolute right, at our sole discretion, to:

• Discontinue the App entirely without prior notice
• Modify, suspend, or remove any features at any time
• Remove the App from the App Store
• Update these Terms at any time
• Terminate your license to use the App if you violate these Terms

Continued use of the App after any modifications to these Terms constitutes acceptance of the modified Terms.

13.1 No Refunds Upon Discontinuation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NO REFUNDS WILL BE PROVIDED UPON SERVICE DISCONTINUATION. BY PURCHASING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT:

• The App may be discontinued at any time without notice
• No refunds will be issued if the App is discontinued
• No refunds will be issued if features are modified or removed
• You waive any claims related to service discontinuation to the maximum extent permitted by law

14. Dispute Resolution & Arbitration

To the extent permitted by applicable law, any dispute, claim, or controversy arising from or relating to these Terms or the App shall be resolved through binding arbitration rather than in court, except for disputes that qualify for small claims court. You agree to waive any right to participate in class action lawsuits or class-wide arbitration to the extent permitted by law.

Nothing in this section limits your statutory rights under applicable consumer protection laws.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands, except where mandatory consumer protection laws provide otherwise.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs regarding the App and supersede any prior agreements, communications, or understandings.
