1. Acceptance of Terms

By downloading, installing, or using StopBrainRot (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

StopBrainRot is developed and operated by Storq Labs BV ("we," "us," or "our"), a company registered in the Netherlands.

2. Description of Service

StopBrainRot is a digital wellbeing iOS application that:

• Allows you to select apps you consider distracting using Apple's FamilyActivityPicker
• Enforces daily limits and time windows using iOS Screen Time APIs
• Displays custom "shield" screens when you attempt to open blocked apps
• Provides friction mechanisms (timers, reflection questions) before allowing override access
• Tracks usage analytics locally to show time saved, streaks, and success rates
• Stores all data locally on your device

3. Age Restrictions

This App is:

• NOT designed for parental controls or monitoring children's device usage
• NOT intended for use by minors
• Designed for adults who want to manage their own digital habits

If you are a parent seeking to manage your child's screen time, please use Apple's built-in Screen Time parental controls instead.

4. Digital Wellbeing Disclaimer

By using this App, you acknowledge and agree that:

• No Medical Advice: The App does not provide medical, psychological, therapeutic, or addiction treatment advice
• No Guarantee of Results: We make NO guarantee that the App will reduce your screen time, break habits, or change behavior in any way
• Results Vary: Individual results depend entirely on personal commitment and circumstances
• Seek Professional Help: If you believe you have an addiction to social media or technology, please consult a qualified healthcare professional
• Tool, Not Treatment: The App is simply a tool that may assist with digital wellbeing—it is not treatment for any condition

5. User Control and Override Access

StopBrainRot is designed with user autonomy in mind. You always maintain control:

• Override Flow: You can always access blocked apps through the in-app override mechanism (which may include waiting periods or reflection questions)
• iOS Settings: You can disable Screen Time entirely through iOS Settings at any time, which will remove all app restrictions
• Uninstall: You can uninstall the App at any time to remove all blocking rules
• Revoke Authorization: You can revoke Screen Time authorization in iOS Settings to disable blocking functionality

6. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent.

7. Prohibited Uses

You agree not to:

• Use the App to monitor or control another person's device
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent the App's blocking mechanisms in ways that violate Apple's terms of service
• Use the App in any way that violates applicable laws or regulations
• Redistribute, sell, or sublicense the App without permission
• Use the App for any purpose other than personal digital wellbeing
• Misrepresent the App's capabilities to others

8. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Effectiveness: We do NOT guarantee the App will reduce your screen time, change your habits, or produce any specific results
• Blocking Reliability: We do NOT guarantee that app blocking will work in all scenarios or that blocks cannot be circumvented
• API Stability: We do NOT guarantee the App will continue to function if Apple modifies or deprecates the Screen Time APIs
• Availability: We do NOT guarantee uninterrupted or error-free operation
• Compatibility: We do NOT guarantee compatibility with all iOS versions or devices
• Fitness for Purpose: We do NOT warrant that the App will meet your particular requirements

9. Limitation of Liability

This includes, without limitation, damages for:

• Failure to achieve desired screen time reduction
• Missed notifications, messages, or content from blocked apps
• Inability to access important information due to app blocking
• Any consequences of using or not using the App
• Loss of productivity, opportunities, or relationships
• Psychological or emotional effects of using the App
• App functionality changes due to iOS updates

Our total liability for any claims arising from the App shall not exceed the amount you paid for the App or any in-app purchases.

10. Third-Party Apps Disclaimer

StopBrainRot is NOT affiliated with, endorsed by, or sponsored by any of the apps it may be used to block, including but not limited to:

• TikTok (ByteDance)
• Instagram, Facebook, Threads (Meta)
• X/Twitter
• YouTube (Google)
• Snapchat
• Any other social media or app platform

All product names, logos, and brands mentioned are property of their respective owners.

11. iOS Platform Disclaimer

StopBrainRot depends on Apple's Screen Time APIs (FamilyControls, ManagedSettings, DeviceActivity). You acknowledge that:

• Apple may modify, restrict, or deprecate these APIs at any time
• iOS updates may affect App functionality without prior notice
• Certain apps (Safari, system apps) cannot be blocked due to iOS limitations
• The App only works on physical iOS devices (not simulators)
• Minimum iOS 16.0 is required
• We are not responsible for any issues caused by iOS updates or Apple's platform changes

12. User-Generated Content

The App may allow you to enter text during override flows (such as reflection questions). This content:

• Is stored locally on your device only
• Is never transmitted to us or any third party
• Is deleted when you uninstall the App
• Remains your property

13. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any claim that your use of the App caused damage to a third party; or (e) any misuse of the App including using it to monitor others.

14. Subscriptions and In-App Purchases

The App may offer subscription plans or in-app purchases:

• All purchases are processed through Apple's App Store and are subject to Apple's terms
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• We do not have access to your payment information
• Refund requests must be directed to Apple at reportaproblem.apple.com

15. Modifications, Termination & Service Availability

We reserve the absolute right to:

• Discontinue the App entirely without prior notice
• Modify, suspend, or remove any features at any time
• Remove the App from the App Store
• Update these Terms at any time
• Terminate your license to use the App if you violate these Terms

Continued use of the App after any modifications to these Terms constitutes acceptance of the modified Terms.

15.1 No Refunds Upon Discontinuation

NO REFUNDS WILL BE PROVIDED UPON SERVICE DISCONTINUATION EXCEPT WHERE REQUIRED BY LAW. BY PURCHASING THIS APP OR ANY IN-APP PURCHASES, YOU ACKNOWLEDGE AND AGREE THAT:

• The App may be discontinued at any time without notice
• No refunds will be issued if the App is discontinued
• No refunds will be issued if features are modified or removed
• You waive any claims related to service discontinuation to the maximum extent permitted by law

16. Dispute Resolution

To the extent permitted by law, you agree that:

• Any disputes will first be attempted to be resolved through informal negotiation by contacting us
• You waive any right to participate in class action lawsuits or class-wide arbitration against us
• Small claims court remains available for disputes within its jurisdiction

If these dispute resolution provisions are found unenforceable in your jurisdiction, the remaining provisions of these Terms remain in effect.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands, except where prohibited by your local law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet disruptions, or Apple platform changes.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements.
