Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Stud Finder ("the App"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

Stud Finder is developed and operated by Storq Labs BV ("Company," "we," "us," or "our"), a company registered in the Netherlands.

2. Description of Service

Stud Finder is a mobile application that uses your iPhone's built-in magnetometer sensor to detect metal fasteners (nails, screws, brackets) hidden inside wall studs. The App provides:

• Real-time magnetic field readings via CoreMotion
• Visual detection gauge showing detection intensity
• Sparkline history graph of recent readings
• Audio tone feedback that changes with detection intensity
• Haptic feedback that intensifies with detection strength
• Adjustable sensitivity slider
• Baseline calibration for ambient magnetic field

All sensor data is processed locally on your device. No data is transmitted to our servers.

3. Intended Use and Audience

Stud Finder is intended for a general adult audience including homeowners, DIYers, and renters. It is designed as an informational tool to help approximate the location of wall studs by detecting metal fasteners.

4. Sensor Limitations and Detection Disclaimer

You acknowledge and agree that:

• The App uses the device's built-in magnetometer (compass sensor) — no external hardware is involved
• Detection is limited to metal fasteners only (nails, screws, brackets). The App CANNOT detect wood studs directly, electrical wiring, gas lines, water pipes, or plumbing
• A "STUD FOUND" indicator means a high magnetic field change was detected — likely a metal fastener nearby — NOT a guaranteed stud location
• Different iPhone models have different magnetometer hardware — results may vary significantly between devices
• Phone case material (especially magnetic cases like MagSafe) can significantly affect readings
• Wall composition (drywall, plaster, concrete, brick, metal studs) affects detection accuracy
• Environmental interference from nearby electronics, appliances, magnets, metal furniture, and electromagnetic fields can affect readings
• Baseline calibration is approximate and may drift over time. The App provides no guarantee of calibrated accuracy
• The App may show false positives (detecting metal that is not a stud fastener) or false negatives (missing stud fasteners)
• Accuracy is not guaranteed under any circumstances

6. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on iPhone devices you own or control, solely for your personal, non-commercial purposes.

You may NOT:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove, alter, or obscure any proprietary notices or labels
• Use the App to develop a competing product or service
• Use the App in any way that violates applicable laws or regulations
• Misrepresent the App's readings as professional or scientific measurements
• Use the App for commercial construction or inspection services without separate written authorization

7. Prohibited Uses

You agree NOT to use the App to:

• Use the App as the sole method for locating studs before drilling, hammering, or cutting — always verify with additional methods
• Rely on the App for locating electrical wiring, gas lines, water pipes, or other hidden hazards
• Make safety-critical construction or renovation decisions based solely on the App's readings
• Provide professional construction, inspection, or safety services based on the App
• Claim detection results as professional or scientifically calibrated measurements
• Use the App for any purpose where failure to detect or inaccurate detection could result in harm, injury, or property damage
• Attempt to circumvent any security or access control measures

8. No Account Required

The App does not require account creation or login. All data is stored locally on your device. We do not collect, store, or have access to your sensor data or app settings.

9. Advertising and In-App Purchases

9.1 Free Version (Ad-Supported)

The free version displays advertisements via Google AdMob, including banner ads and interstitial ads. Ad display is subject to Google's policies and may include personalized or non-personalized ads depending on your tracking preferences.

9.2 Stud Finder Pro (One-Time Purchase)

Stud Finder Pro is available as a one-time in-app purchase ($2.99 USD or local equivalent) that removes all advertisements from the App. This is a digital content unlock, not a service guarantee. Purchasing Pro does not guarantee continued availability of the App, future updates, or specific functionality.

9.3 Payment Processing

All purchases are processed exclusively through the Apple App Store via StoreKit 2. We do not collect, process, or store any payment information. By making a purchase, you agree to Apple's terms and conditions.

10. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to the app design, code, user interface, graphics, branding, signal processing algorithms, and documentation are owned by Storq Labs BV and are protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, service marks, or trade names.

11. Disclaimer of Warranties

WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT:

• Stud detection readings will be accurate, reliable, or complete
• The App will detect all metal fasteners in wall studs
• The App will correctly indicate the presence or absence of wall studs
• The App can detect or warn of hidden wiring, gas lines, plumbing, or other hazards
• Calibration will provide a stable or accurate baseline
• The App will perform consistently across different iPhone models
• The App will function reliably with all wall types and compositions
• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Any errors in the App will be corrected

12. Limitation of Liability

SPECIFICALLY, WE ARE NOT LIABLE FOR:

• Failure to detect metal fasteners, studs, or any other objects
• False positive or false negative detection readings
• Damage caused by drilling, hammering, or cutting into walls based on the App's readings
• Electrocution, gas leaks, water damage, or fire resulting from reliance on the App
• Personal injury, death, or property damage arising from reliance on the App
• Damage to your device from use of the App
• Any loss or damage resulting from environmental interference affecting readings
• Decisions made based on the App's detection results

OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount you actually paid for Stud Finder Pro; or
• Five US Dollars ($5.00)

13. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Decisions made based on the App's detection readings
• Any claim that you relied on the App for safety-critical purposes
• Any property damage, personal injury, or death resulting from your use of or reliance on the App
• Your violation of these Terms or any applicable law
• Your failure to verify stud locations or check for hidden hazards using professional methods

14. Modifications, Termination & Service Availability

14.1 Modifications to the App

We reserve the absolute right to modify, suspend, or discontinue the App (or any features thereof) at any time, with or without notice, for any reason. This includes detection algorithms, sensitivity ranges, UI elements, and feature availability. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

14.2 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated effective date. Your continued use of the App constitutes acceptance of modified Terms.

14.3 Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason. Upon termination, your license to use the App terminates immediately.

15. Apple EULA Compliance

These Terms are supplemental to, and do not replace, Apple's standard Licensed Application End User License Agreement. You acknowledge and agree that:

• These Terms are between you and Storq Labs BV only, and not with Apple
• Apple has no obligation to furnish any maintenance or support services for the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App
• Apple is not responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

16. Force Majeure, Governing Law & Jurisdiction

We shall not be liable for any failure or delay in performing our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of telecommunications or information systems, or any other circumstances beyond our reasonable control.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

17. Dispute Resolution and Arbitration

17.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@storqlabs.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

17.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the App shall be finally resolved by binding arbitration administered by a mutually agreed-upon arbitration body under its rules then in effect.

17.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Severability, Waiver & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

The failure of Storq Labs BV to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements, communications, or understandings, whether oral or written, regarding the subject matter hereof.
