1. Acceptance of Terms

By downloading, installing, or using Thermostat Game (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Thermostat Game is developed and operated by Storq Labs BV ("we," "us," or "our"), an independent developer based in the Netherlands.

2. Entertainment Purpose Only

Please understand the following:

• This app is inspired by viral social media trends and is meant purely for fun
• Scores are based on simple number comparison and have no meaning beyond entertainment
• The app makes no claims about measuring any real-world abilities or characteristics
• Do NOT use this app for any decision-making, betting, gambling, or anything beyond casual entertainment
• We are NOT responsible for how you or others interpret or react to gameplay results
• We are NOT responsible for social outcomes or consequences of playing the game

3. Description of Service

Thermostat Game is a mobile app that:

• Generates random numbers for guessing games
• Records videos of players "acting out" numbers
• Provides an interactive dial/thermostat interface for guessing
• Calculates scores based on guess accuracy
• Exports videos with results overlay for sharing
• Operates entirely offline on your device

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App without our prior written consent. We reserve all rights not expressly granted in these Terms.

5. No Reliance

• Random number generation is based on standard algorithms with no guaranteed fairness
• Scores are simple mathematical calculations with no deeper significance
• Video processing is provided "as is" without quality guarantees
• We make no guarantees about the entertainment value of the app

6. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Merchantability: No warranty that the App is fit for sale or general use.
• Fitness for Particular Purpose: No warranty that the App will meet your specific requirements.
• Non-Infringement: No warranty that the App does not infringe third-party rights.
• Error-Free Operation: No warranty that the App will operate without errors or interruptions.
• Video Quality: No warranty regarding video recording quality, processing, or export.
• Availability: No warranty of uninterrupted service or future availability.

7. Limitation of Liability

WE DISCLAIM ALL LIABILITY. This includes, without limitation, damages for:

• Social Consequences: Any disputes, arguments, embarrassment, or relationship issues arising from gameplay
• Content Shared: Any consequences from videos you create and share on social media
• Third-Party Platforms: How TikTok, Instagram, or other platforms handle your shared content
• Device Issues: Battery drain, storage usage, device overheating, or any hardware problems
• Lost Videos: Videos not saved properly or corrupted during export
• Privacy Issues: Content you inadvertently record or share

Maximum Liability: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP ($0.00 USD FOR FREE APPS).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Camera and Video Usage

The App uses your device's camera and microphone to record videos. By using these features:

• You are solely responsible for what you record and who appears in your videos
• You must have consent from anyone appearing in videos you create
• You must comply with all applicable laws regarding recording and sharing videos
• You must not record in locations where recording is prohibited
• We are NOT responsible for the content of videos you create
• We are NOT responsible for any violations of privacy or consent laws

9. User-Generated Content

Regarding videos and content you create:

• Ownership: You retain ownership of all videos you create
• License to Process: You grant us a limited license to process your videos locally on your device for the purpose of adding the results overlay
• Responsibility: You are solely responsible for all content you create, save, and share
• Third-Party Sharing: Once you share content to third-party platforms, their terms and policies apply

10. Intellectual Property

The App, including its code, design, graphics, UI elements, and documentation, is protected by intellectual property laws. All rights not expressly granted are reserved by Storq Labs BV.

The "Thermostat" game concept is based on a viral social media trend. We make no claim to the underlying game concept, only to our specific implementation.

11. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, sell, or sublicense the App
• Use the App for any illegal purpose
• Use the App in violation of Apple's or Google's terms of service
• Record or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Record people without their consent or in violation of their privacy
• Use the App for gambling, betting, or any form of wagering
• Use the App for commercial purposes without written consent
• Misrepresent results or scores as having any scientific or legitimate meaning

12. Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Storq Labs BV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, save, or share using the App
• Disputes with other players or people appearing in videos
• Any claims related to videos you share on social media
• Any violation of privacy, consent, or recording laws

13. Age Restrictions

This App is intended for users aged 13 and older. By using the App, you represent that:

• You are at least 13 years of age
• If you are under 18, you have parental or guardian consent to use the App
• Parents/guardians are responsible for monitoring their children's use and any content they create or share

14. App Availability & Discontinuation

We reserve the absolute right to:

• Discontinue the App entirely at any time without notice
• Modify, add, or remove App features without notice
• Stop providing updates, support, or maintenance at any time
• Remove the App from app stores
• Change these Terms at any time
• Terminate your license to use the App if you violate these Terms

15. Future Features & Monetization

We may add premium features, in-app purchases, or other monetization in the future. Any such features will be clearly disclosed and optional. We reserve the right to change our monetization model at any time.

16. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us at hello@storqlabs.com to attempt to resolve the dispute informally.

Individual Basis: Any disputes shall be resolved on an individual basis. You waive any right to participate in class actions or class arbitrations to the extent permitted by law.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

Users in other jurisdictions use this app at their own risk. We will comply with local laws where legally required but limit liability to the maximum extent permitted by law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs BV regarding the App and supersede any prior agreements. This App provides no professional advice of any kind.
