1. Acceptance of Terms

By downloading, installing, or using WhoWon (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

WhoWon is developed and operated by Storq Labs BV ("we," "us," or "our"), a company registered in the Netherlands.

2. Description of Service

WhoWon is an AI-powered app that analyzes uploaded text screenshots and photos to generate verdicts, power scores, and shareable verdict cards. The App:

• Allows you to upload up to 5 screenshots or photos per verdict
• Uses AI to analyze text tone, logic, and conversation dynamics
• Generates verdict cards that can be shared on social media
• Does not require account creation or login

3. Entertainment Purposes Only

You expressly acknowledge and agree that:

• Verdicts are AI-generated opinions for entertainment and should not be taken as fact
• The App does not provide legal, medical, psychological, or professional advice of any kind
• You should not make any decisions based on verdicts generated by the App
• AI analysis may be inaccurate, biased, or incomplete

4. User Responsibilities

By using WhoWon, you agree to:

• Use the App only for lawful purposes
• Only upload content that you have the right to share
• Not upload content containing illegal material, child exploitation, or content that violates the rights of others
• Obtain consent from any individuals whose conversations or photos you upload
• Not use the App to harass, bully, defame, or threaten others
• Not use generated verdict cards to harm, harass, or mislead others

5. Content You Upload

You are solely responsible for the content you upload to the App. You represent and warrant that:

• You own or have permission to use the content you upload
• Your content does not infringe on the intellectual property rights of others
• Your content does not violate any applicable laws or regulations

We do not store your uploaded images after processing. However, we are not responsible for any consequences arising from content you choose to upload or share.

6. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Upload content without the consent of the people involved
• Use the App or its verdicts to harass, bully, or threaten others
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App or its servers
• Sell, resell, or commercially exploit the App without our consent

7. Disclaimer of Warranties

We specifically disclaim all warranties including, but not limited to:

• Accuracy: We do not warrant that AI verdicts are accurate, fair, or unbiased
• Reliability: We do not warrant that the App will be uninterrupted or error-free
• Fitness: We do not warrant that the App is fit for any particular purpose

8. Limitation of Liability

This includes, without limitation, damages arising from:

• AI-generated verdicts or analysis
• Sharing of verdict cards on social media
• Content you upload to the App
• Service outages or technical failures
• Actions of third parties in response to shared verdicts

Our total liability shall not exceed the amount you paid for the App (which is currently zero, as the App is free).

9. Indemnification

You agree to indemnify, defend, and hold harmless Storq Labs BV and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, content you upload, or your violation of any rights of another party.

10. Intellectual Property

The App, including its code, design, graphics, and documentation, is owned by Storq Labs BV and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved.

11. Termination & Service Discontinuation

We reserve the right to:

• Discontinue the App entirely without prior notice
• Modify, suspend, or remove any features at any time
• Stop providing updates, support, or maintenance
• Suspend or terminate your access to the App at any time, for any reason, without notice

No refunds or compensation will be provided upon service discontinuation.

12. Dispute Resolution

• Governing Law: These Terms are governed by the laws of the Netherlands
• Jurisdiction: Any legal action must be brought in the courts of the Netherlands

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.
